Terms and Conditions

Our customers are important to us and we want to ensure we provide the best learning environment for all. Therefore we have some terms and conditions to make it easier for everyone to get the best training possible.

Your use of the website and participation in training provided by Aspire Australasia Pty Ltd is conditional upon your acceptance and compliance with the terms and conditions set out below. You should read them now.

The Inspiring Projects website is operated by Aspire Australasia Pty Limited (ABN: 63 122 098 686), trading as Inspiring Projects. All references to Inspiring Projects in these terms and conditions shall be taken to mean Aspire Australasia Pty Ltd.

What is Offered

Delegates to a course will be provided with:

  • All course materials identified in the course description, such as eLearning environments, workbooks and materials for activities;
  • Reference manuals where identified in the course description;
  • A seat in each of the certification exams identified in the course description, if the delegate has selected a package that includes these certification exams;
  • Certificate of attainment, where a delegate has taken and passed a certification exam;
  • Lunch, and morning and afternoon tea (for full day premium public classroom courses only);
  • Certificate of attendance, on request.

Computers are not required for delegates to any of our business skills courses taken in classroom or self study mode. Computers and internet access are required for delegates taking a course in eLearning mode or taking a certification exam online. It is the responsibility of delegates to provide suitable computer devices and internet access.

Courses are non-residential (i.e. no overnight accommodation is provided) unless specified.

Our quoted fees assume that the related course and package will be taken in Australia. For delegates outside Australia, where materials must be posted to the delegate, we will add a postage fee to quoted course fees. This fee will be the minimum fee charged by Australia Post to deliver the materials to the delegate with a tracking option.

Exams

We conduct certification exams associated with our AXELOS-product courses (PRINCE2, PRINCE2 Agile, MSP, MoP, P3O, MoV and M_o_R) on behalf of the relevant Examiination Institute, and under their terms and conditions,

We conduct certification exams associated with our APMG-product courses (Praxis Framework, Managing Benefits, Change Management, Agile Project Management, Better Business Cases) on behalf of the relevant Examination Institute, and under their terms and conditions.

Please note: Exam candidates must bring signed photo ID (passport, driving licence, etc.) as they will be asked to produce it by the invigilator prior to the exam.

Registration

Bookings are confirmed only when we advise we have secured a place for you, and you have made arrangements to pay in full.

Course availability is indicative, and may change without notice.

Special Needs

We ask delegates to inform us of any special needs they may have on the course Registration Form or by other means. When we have been informed of such special needs, we will attempt to ensure that these needs are addressed.

Where a delegate has a special need, but does not inform us of this need when registering for a course, we will attempt to meet this need but are under no obligation to do so.

Personal Belongings

Personal belongings brought to a course venue by a delegate are the sole responsibility of that delegate. Inspiring Projects accepts no responsibility for loss or damage of such personal belongings.

Location and Venue

Generally our classroom-style courses are held at centrally located venues in the cities noted in our Training Schedules.

Venue information is indicative, and may change without notice.

The venue address will be confirmed at least one week prior to the start of the course. If you have a confirmed enrolment in a course, you will be notified immediately of any change in venue.

For candidates in a classroom-style course, the certification exams will be held at the conclusion of each course element. Where this is not convenient for a candidate, we will book an online exam for that candidate; they will need to ensure that they can access the exams over the internet.

Payment

The fee for a course provided to an individual is generally required to be paid before commencement of that course. Course material will generally not be provided to individuals until payment in full is received.

Inspiring Projects runs in-house courses, and will claim payment for these courses by invoice raised at the completion of each such course. For an in-house course run for a direct client of Inspiring Projects, the direct client organisation will be invoiced for the course, and will be held liable for payment of our invoice. For an in-house course run for the client of another training organisation, the other training organisation will be invoiced for the course, and will be held liable for payment of our invoice.

Inspiring Projects accepts payment by credit or debit card through PayPal or payment by direct deposit into our bank account. Credit terms are at the discretion of Inspiring Projects and are subject to satisfactory references and trading volumes.

Inspiring Projects will exercise its statutory right to claim interest on debts owed and compensation for all associated debt recovery costs if payment is not received in accordance with Inspiring Projects' specified terms. The interest rate used for calculation of interest on debts will be the applicable penalty interest rate published by the Magistrate's Court of Victoria.

Withdrawal

Where a confirmed delegate withdraws from a public course more than 10 business days from the scheduled start of the course, the full course fee will be refunded, less the cost of materials already provided to the delegate which cannot be returned in merchantable condition.

Where a confirmed delegate withdraws from a public course less than 10 business days from the scheduled start of the course, the full course fee will be forfeited.

Where a confirmed delegate withdraws from a Self Study or e-Learning course after materials have been provided or dispatched to the delegate, the cost of exams not taken will be refunded to the delegate, and the cost of reference manuals will be refunded provided the reference manual is returned to Inspiring Projects in merchantable condition.

Courses Cancelled By Us

Inspiring Projects reserves the right to cancel public courses and refund fees. All public classroom courses are dependent on our obtaining sufficient registrations. If you have a confirmed enrolment in a public classroom course, you will be notified immediately in the event of a course cancellation, and the full course fee will be refunded, less the cost of materials already provided to the delegate which cannot be returned in merchantable condition. If a public classroom course for which you have a confirmed registration is cancelled, you may apply the balance of your payment to the same course on another date or to another course of your choice, at your discretion.

Return of materials

You must obtain authorisation for return of materials we have supplied to you prior to dispatching such materials to us. To obtain authorisation for return, please contact us on training@inspiringprojects.com.au.

Unless we dispatched materials to you in error, or the materials were received by you in a damaged or defective state, we will only accept return of materials that are in a merchantable condition.

Please note that you will be responsible for the costs of returning materials to us, unless these materials were dispatched to you in error or were received by you in a damaged or defective condition.

Confidentiality

Each party will keep confidential and not disclose or make public the Confidential Information of the other party without the prior written consent of the other party.

Formation of Contract

Registration of a request for training made by an individual, whether for themself and/or for others, is an offer by that individual to purchase that training for all delegates registered by that individual for the price (including delivery and other charges and taxes) specified in this website at the time that individual placed such order on these terms and conditions.

Inspiring Projects reserves the right to accept or reject such an offer for any reason, including, without limitation, the unavailability of such training, an error in the price or the course description posted on this website, or an error in the registration.

A contract between that individual and Aspire Australasia Pty Ltd comes into existence when Inspiring Projects forwards confirmation of registration to that individual or dispatches course materials to delegates registered by that individual.

Title and Risk

Inspiring Projects will retain title to all materials provided to a delegate in association with training until payment in full is made for such training, but all risk in such materials will pass to the delegate upon such materials' delivery to or collection by a postal or courier service. Each delegate should consider whether to obtain any suitable insurance.

In the event of non-payment of training fees owed by or on behalf of a delegate, that delegate will return to Inspiring Projects' office all such materials provided to them by Inspiring Projects, at their own expense.

Capacity

Training offered by Inspiring Projects is only offered to individuals and entities which can make legally binding contracts. Our training is not offered to persons under the age of 18 years and any other persons or entities who are legally prohibited from entering into binding contracts.

Limitation of Liability

In the unlikely event of any claim, action or demand made against Inspiring Projects by a delegate, liability will be capped at the total amount of fees pertaining to training received from the delegate in the prior 2 month period.

Severability

If any provision of these terms is held to be invalid, all the other provisions of these terms will remain in full force and effect.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.

You agree to submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia.

Entire Agreement

These terms and conditions supersede all prior agreements, arrangements and undertakings between you and Inspiring Projects in relation to goods and services provided to you or on your behalf to others, and constitute the entire agreement between you and Inspiring Projects in relation to such goods and services.

Acceptance

Your use of this website or attendance at a training course provided by Inspiring Projects is conditional upon your acceptance and compliance with these terms and conditions. Your use of the website or attendance at a training course constitutes your agreement to these terms and conditions.
